Prempro Lawsuit
If you or a loved one has been damaged because of Prempro or another HRT regime, you should consult with a qualified personal injury lawyer or pharmaceutical attorney to learn if you may be eligible for compensation.
Attempts to file at least two Prempro class action lawsuits were made but neither attempt was successful in securing class action certification. Certification was denied in 2005, in Arkansas as well as 2006, in Florida. Neither of these rulings should have an effect on individuals who feel they wish to file their own Prempro lawsuit, however. Examples of Negligence
The incidence of breast and other cancers in women who took Prempro was calculated at about 25% greater than that of the general population. Evidence of coronary disease causing blood clots, heart attack and stroke was also recorded.
Potential Recovery
$2.75-million: Jury award in 2007 to an Arkansas woman who claimed that her breast cancer and subsequent double mastectomy were both due to her 10 years of Prempro medication.
$1.5 million: Compensatory damages by a Philadelphia jury, in 2006, to a 66-year-old Ohio woman after it was determined that Prempro – which she took for 5 years to treat menopausal symptoms – was a significant cause of her breast cancer.
That same day, October 6, a Philadelphia jury ruled that HRT was responsible, at least partially, for a Reno woman's breast cancer. An out-of-court settlement was reached between plaintiff and the drug maker.
$134.5-million: This 2007 judgment was levied against Wyeth in a lawsuit filed by three Nevada women who claimed that the company's hormone-replacement drugs had caused their breast cancers. It is the largest award to date against the Madison, N.J. manufacturer, which faces more than 5,000 Prempro lawsuits in state and federal courts across the country.
If you are currently taking Prempro and are experiencing serious side effects which you feel are cause for concern, you should first speak with your physician about whether the drug’s benefits outweigh its risks before you discontinue use or switch to an alternate treatment.
